Аннотация. В статье рассматриваются подходы Совета Европы к проблемам миграции, отразившиеся прежде всего в большом числе выработанных в нем конвенций, рекомендаций, а также методических пособий, исследований и докладов. В этих актах и документах регулируются основные вопросы правового положения мигрантов или даются практические советы государствам-членам по обеспечению их прав и их интеграции в принимающие общества. Большой интерес представляют также концептуальные подходы СЕ к роли миграционных процессов в экономическом и социальном развитии европейских стран и к проблемам «мультикультурного общества».

Abstract. The article considers the approach of the Council of Europe to migration problem which is reflected in a great number of conventions, recommendations, instructional guidelines and reports, elaborated by this organization. These instruments and documents contain provisions for regulations concerning the main questions of the legal status of migrants or practical advice to member states aimed at ensuring their rights and their integration in society. The conceptual approaches of the Council of Europe towards the role of migration processes in the economic and social development of the European countries and towards the problems of the «multicultural society» are also of great interest.

Совет Европы, учрежденный в 1949 г. и объединяющий ныне 47 государств-членов (все признанные государства континента, кроме Беларуси), изначально создавался как организация, имеющая главной целью продвижение демократии, прав человека и верховенства закона. Соответственно, любая проблематика, которая затрагивается СЕ, рассматривается прежде всего через призму этих «общих европейских ценностей». В зависимости от конкретной проблемы акцент может ставиться на одной из частей указанного «триптиха». В частности, вопросы миграции 6 трактуются главным образом с точки зрения защиты прав человека. На это направлены как довольно большое число международно-правовых инструментов СЕ, выработанных за время его существования, так и практическая деятельность ряда его органов.
